If Adopted, Overtime Pay Rules May Expand to More Employees

Today (and since 2004) salaried employees who earn at least $455 per week aren't eligible for overtime pay under the Fair Labor Standards Act, if their job duties are executive, administrative or professional (EAP) in nature. That's true no matter how many hours these employees work in a week.

Updated FLSA Minimum Wage and Overtime Standards for White Collar Workers

On May 18, 2016, the Department of Labor (DOL) Wage and Hour Division published their final rule regarding overtime regulations. These update the so-called “white collar” exemptions in the Fair Labor Standards Act (FLSA) and automatically extend overtime pay protections to over 4 million workers. Employees who meet the duties and salary requirements set forth are exempt from both the minimum wage and overtime provisions of the FLSA. The new regulations will take effect on December 1, 2016.
